Agreement to Terms
Welcome to FlowRoutine. These Terms of Service ("Terms") govern your access to and use of the FlowRoutine mobile application (the "App") operated by Daybreak Labs ("we," "our," or "us").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
We reserve the right to modify these Terms at any time. Your continued use of the App after any changes indicates your acceptance of the new Terms.
License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, solely for your personal, non-commercial use.
You may not:
• Copy, modify, or distribute the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, or lend the App to third parties
• Use the App for any illegal or unauthorized purpose
• Remove any copyright or proprietary notices from the App
User Accounts
To access certain features of the App, you may need to create an account using Apple Sign-In.
Account Responsibilities:
• You are responsible for maintaining the security of your account
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use
• You must provide accurate and complete information
Account Termination:
We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or harmful conduct. You may delete your account at any time through the App settings.
Subscriptions and Payments
FlowRoutine offers subscription-based premium features through in-app purchases processed by Apple.
Subscription Terms:
• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings
Free Trials:
• Some subscriptions may include a free trial period
• Any unused portion of a free trial will be forfeited when you purchase a subscription
• Free trials are limited to one per Apple ID
Refunds:
All purchases are processed by Apple. For refund requests, please contact Apple Support directly through their standard refund process.
Price Changes:
We may change subscription prices at any time. Price changes will take effect at the start of the next subscription period after the change. Your continued use of the subscription after the price change constitutes acceptance of the new price.
User Content
You retain ownership of any content you create within the App, including routines, step descriptions, and notes ("User Content").
License to Us:
By creating User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your User Content solely for the purpose of providing and improving the App.
Your Responsibilities:
• You are solely responsible for your User Content
• You must not create User Content that is illegal, harmful, or infringes on others' rights
• You must not use the App to harass, abuse, or harm others
AI-Generated Content:
When you use AI features to generate routines, the resulting suggestions are provided "as-is." We do not guarantee the accuracy, safety, or suitability of AI-generated content. You are responsible for reviewing and modifying AI suggestions before use.
AI Features and Third-Party Services
FlowRoutine uses OpenAI's services to power AI routine generation features.
AI Service Terms:
• When you use AI features, your prompts are sent to OpenAI for processing
• AI-generated content is provided for informational purposes only
• We are not responsible for any actions you take based on AI suggestions
• AI features may be subject to additional terms from OpenAI
Third-Party Services:
The App integrates with third-party services including OpenAI, RevenueCat, Mixpanel, and Supabase. Your use of these services is subject to their respective terms of service and privacy policies.
Data Processing:
By using AI features, you consent to your prompts being processed by OpenAI in accordance with their data usage policies. We encourage you to review OpenAI's privacy policy for more information.
Intellectual Property
The App and its original content, features, and functionality are owned by Daybreak Labs and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Our Trademarks:
"FlowRoutine" and the FlowRoutine logo are trademarks of Daybreak Labs. You may not use our trademarks without our prior written consent.
Feedback:
If you provide us with feedback or suggestions about the App, you grant us the right to use that feedback without any obligation to you.
Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
• The App will be uninterrupted, secure, or error-free
• The results obtained from the App will be accurate or reliable
• Any errors in the App will be corrected
Health Disclaimer:
FlowRoutine is a productivity and routine management app. It is not intended to provide medical, health, or fitness advice. Always consult appropriate professionals before making health-related decisions.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAYBREAK LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
In no event shall our total liability exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless Daybreak Labs and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:
• Your use of the App
• Your violation of these Terms
• Your violation of any third-party right, including intellectual property rights
• Your User Content
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that you may bring claims in small claims court if eligible.
You agree to waive any right to participate in class action lawsuits against us.
Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination:
• Your right to use the App will cease immediately
• We may delete your account and User Content
• Provisions of these Terms that should survive termination will remain in effect
You may terminate your use of the App at any time by deleting the App and, if applicable, deleting your account.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
